

Public Law 106-50, the Veterans Entrepreneurship and Small Business Development Act of 1999, amended the Small Business Act to establish new assistance programs for small businesses owned and controlled by veterans (VOSB) and small businesses owned and controlled by service-disabled veterans (SDVOSB).
The law requires Federal agencies to afford these businesses maximum practical opportunity to participate in the performance of prime contracts and subcontracts. It specifically established a Government-wide goal of awarding not less than 3 percent of the total value of all prime contract and subcontract awards to service-disabled veteran-owned small businesses. It also established a requirement to include a goal for subcontracting with veteran-owned small business concerns in subcontracting plans approved for large business prime contractors
Federal agencies work with the Small Business Administration to establish goals and collect data regarding subcontracts awarded by large business prime contractors to veteran-owned small businesses. Each subcontracting plan approved by the agency and the Small Business Administration must include separate percentage goals for veteran owned small business (VSOB) and service-disabled veteran owned small business (SDVOSB).
Public Law 108-183, the Veteran’s Benefit Act of 2003 establishes a procurement program for service-disabled veteran-owned small business and provides additional authority to set aside procurements exclusively for service-disabled veteran-owned small businesses if there is a reasonable expectation that two or more SDVOSBs would bid and award could be made at a reasonable price. It also permits contracting officers to make sole source contract awards If only one SDVOSB can satisfy the requirement and the anticipated award value will not exceed $5 million for manufacturing NAICS codes and $3 million for other NAICS codes.
On October 21, 2004, President Bush signed Executive Order 13360 calling on Federal agencies to take additional actions necessary to achieve the goals of this legislation.
